User Agreement

Welcome to Cardgifters, a service provided by Skillzena LTD (Registration number 14816795, registration address: Suite 102c1, 34-44 London Road, Morden, United Kingdom, SM4 5BX;  (“we”, “us”, “our”, Cardgifters), and our website (“Site”). By accessing the Site and using our services (collectively, the “Service”), you agree to be bound by the following User Agreement and Terms of Use (collectively, “Terms”).

These Terms, including our Privacy Policy, constitute a legally binding agreement between you (“you”, “your”, “User”) and Cardgifters. By using the Service, you represent that you are at least 18 years old and have read, understood, and agreed to be bound by the Terms, regardless of the device or platform by which you access the Site. If you do not agree to these Terms or are under the age of 18, you are not permitted to use the Site or the Platform Service.

We reserve the right to modify the Terms (including our Privacy Policy) at any time in our sole discretion. We will post any changes to the Site or notify you by email. Your continued use of the Service following any changes to the Terms indicates your acceptance of the revised Terms. Whenever the word “including” appears in the Terms, it means “including but not limited to”.

Images on Cardgifters’ website are for illustrative purposes only. They do not depict our actual employees, office, or facilities.

User Account

When you create an account, registry, or wish list, make a purchase, send a gift card, launch a group gift or contribute to any group gifting event (“Group Gift”) on Cardgifters, you agree to the following terms: 

a) You must provide a valid email address of your own; 

b) If required, you must create a username and password; 

c) All information that you submit must be accurate and not misleading; 

d) You must keep your account information, including your username and password, confidential; 

e) You are responsible for any and all activities that occur under your account, regardless of whether or not you authorised such activities; 

f) You must keep the information of other users’ accounts confidential if you have access to it; 

g) If you suspect any unauthorised use of your account, you must immediately inform us; 

h) You must not use the Cardgifters Service for any unlawful or otherwise prohibited activities.

Billing

Please take note that when you make a purchase on CARDGIFTERS.COM, the name “CARDGIFTERS.COM” will be indicated on your bank or credit card statement. This name serves as a transaction reference and ensures that the payment is linked to your purchase from our website.

Cardgifters Service

The Cardgifters Service allows Users to purchase only digital gift cards (“Gift Cards”) for themselves or others or to contribute privately to a Group Gift (“Contributor”) for a recipient (“Recipient”), (collectively “User” or “Users”). The Recipient may receive the digital gift card via email or text. The Gift Cards are issued by specific Retailers, and the use and redemption of these Gift Cards are subject to the policies of the relevant Retailer (refer to the Gift Card section below for more details).

To use the Service, a User must create a Cardgifters account and may choose to create a unique password for account access. To purchase or contribute to a Gift Card, the User selects a Recipient, specifies the purchase amount or enters a contribution amount for a Group Gift, optionally personalises the Gift Card, completes the purchase process, and may invite others to contribute to the Gift Card’s value. Payment must be made using a valid payment method, such as a credit card or an accepted alternate payment method.

You are solely responsible for preventing unauthorised use of your unique User ID for any and all access to the Site and your use of the Services. You must not authorise any other person or entity to use your User ID. In the event of any unauthorised activity, you agree to notify Cardgifters immediately.

While using the Cardgifters Service, you have the option to purchase or contribute towards the purchase of a Gift Card. However, Cardgifters will only handle the transaction for your payment towards the Gift Card and any applicable fees for using the Service. We have no control over any other Contributors, the intended Recipient, or any other Users of the Service, as well as the Retailer. Therefore, we will not be responsible for any loss or damage you may incur due to your interactions or transactions with any Users or Retailers. This includes any loss or damage resulting from (i) contributing, (ii) late or failed delivery of any product or service purchased through the Retailer, including Gift Cards, (iii) any defect or other quality aspect of any product or service, (iv) breach of any Retailer warranty, express or implied, or (v) Retailer’s failure to redeem the Gift Card.

We are not responsible for any changes in any Retailer’s Gift Card terms and conditions, including any price change that may occur after you purchase or contribute to a Gift Card but before its redemption for the applicable product or service. Please note that except for Cardgifters сard(s), we do not issue Gift Cards through the Service, and the liability for the Redemption of the Gift Card lies with the Issuer.

By participating in any dispute or its resolution, you agree to indemnify and hold harmless Cardgifters and its officers, employees, members, managers, affiliates, subsidiaries, agents, representatives, and successors from any and all Losses related to such dispute, including any third-party claims, costs, losses, liabilities, and expenses (including damage awards, settlement amounts, and reasonable attorneys’ fees and costs, whether incurred as the result of a third-party claim or a claim to enforce these Terms), and other damages of any kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, liquidated, or otherwise.

You and other Service Users provide various information and materials to the Site, including but not limited to text, images, videos, and audio (“Content”). We do not control, endorse, or verify any of the Content you or other Users provided. By using the Platform Service, you acknowledge and agree that we may use your Content to provide the Platform Service, as well as for statistical, analytical, reporting, and other purposes, as outlined in our Privacy Policy.

We reserve the right to terminate a User account at any time, at our sole discretion, for any reason, including but not limited to:

  • Submitting any Content that is unlawful, harassing, libellous, abusive, threatening, harmful, bigoted, racially offensive, obscene, or otherwise objectionable;
  • Posting any sexually explicit Content;
  • Using language or engaging in User conduct that could potentially constitute a criminal offence, give rise to civil liability, or violate any applicable local, state, national, or international law or regulation;
  • Posting any unsolicited or unauthorised advertising, spam, or junk mail, including chain letters and pyramid schemes;
  • Submitting any Content that is alleged to infringe upon any patent, trademark, trade secret, copyright, or other proprietary right;
  • Uploading any virus or other Content designed to disrupt, limit, or damage any functionality of any computer software or hardware; or
  • Posting Content originally posted by another User without permission or attribution.

If you believe that any Content violates any of the above guidelines or is otherwise objectionable, please notify us by using the support link provided on the Service. We reserve the right to decide whether any Term has been violated and what action, if any, should be taken, in our sole discretion.

Cardgifters act as a payment processor for your transactions whenever you make a contribution or purchase. All payments are then applied to a gift card that can be redeemed by the recipient or organiser of the group gift. Cardgifters does not hold any banking licences or represent itself as a chartered depository institution. Rather, it provides a platform that allows users to purchase digital gift cards or facilitate a group gift for retailer gift cards. Except for Cardgifters card(s), Cardgifters is not responsible for issuing any of the gift cards available on the platform. Once a gift card is purchased through Cardgifters, the issuer is fully responsible for the redemption of the gift card.

Available Delivery Options

At Cardgifters, we offer convenient delivery options to ensure that you or your recipient receive your gift cards in a timely manner. We understand the importance of a seamless gifting experience and strive to accommodate your preferences. However, it’s essential to note that the available delivery methods may vary based on your location.

Email Delivery

For most countries, we provide the option to deliver gift cards directly to your email address. This delivery method is efficient, secure, and allows for instant access to your digital gift card. Upon completion of your purchase, you will receive an email containing all the necessary details and instructions to redeem your gift card.

SMS Delivery

We also offer the option to deliver gift cards via SMS (Short Message Service). This convenient delivery method enables you or your recipient to receive the gift card details directly on your mobile device. Simply ensure that you provide a valid phone number during the checkout process, and we will send the gift card information via SMS.

Digital Delivery Only

Please note that all the gift cards available on Cardgifters are digital options. We do not send physical cards to physical addresses. Our focus is on providing a seamless and environmentally friendly digital gifting experience. Rest assured that each gift card purchased through our Service is in a digital format, ensuring convenience and ease of use.

Location-Based Delivery Limitations

Due to various factors and regional regulations, the availability of delivery methods may differ based on your location. In some countries, we can deliver gift cards exclusively via email. We apologise for any inconvenience this may cause and assure you that we continually strive to expand our delivery options to cater to users worldwide.

It is important to review the specific delivery options available during the checkout process. The delivery method presented will be based on your location and the requirements set by the brand issuing the gift card.

We are committed to providing a smooth and efficient gift card delivery experience, leveraging the power of digital technology. Gift Cards Usage

When you place an order or contribute to a Gift Card through Cardgifters, you agree to purchase the digital Gift Card (or contribute to it, if applicable). Once your payment is completed, your selected payment method will be charged for the paid portion of the Gift Card value and any applicable fees for using the Service. After payment confirmation, you will receive a voucher available for use for you or the Recipient or applied to a Group Gift through the Cardgifters Service. Additional measures may be necessary to ensure the authenticity of your transaction and collect your payment information.

Unless stated otherwise, sales taxes are not included in the Gift Card price and may be charged separately by the Retailer at the time of redemption. Cardgifters is not the issuer of any Retailer Gift Cards. The Issuer is responsible for any and all claims or liabilities related to the Gift Cards and any unclaimed property liability arising from unredeemed or partially redeemed Gift Cards. The Recipient acquires the right to redeem the Gift Card and use it subject to the terms of this Agreement.

Once the Gift Card is electronically transmitted to the Recipient, all risk of loss and title for the Gift Card will pass to the Recipient. Cardgifters is not responsible if the voucher  is lost, deleted, or used without permission or if it becomes unsuitable for redemption through no fault of Cardgifters. If there is an error in your Gift Card order, you or the Recipient must notify Cardgifters within 30 days. If the Gift Card balance has not been spent and has not changed from the original amount, Cardgifters will make reasonable efforts to correct the error. If no error is reported within 30 days of the electronic transmission of the Gift Card, the Gift Card will be deemed satisfactory.

Some Retailer Gift Cards may not be redeemable outside of certain countries, and it is your responsibility to confirm if a Retailer’s card can be redeemed internationally. The Gift Card must be redeemed at the applicable Retailer’s website or physical retail store, subject to the Retailer’s then-current terms and conditions. All Retailer Gift Cards are subject to the specific Retailer’s terms and conditions.

Claiming a Gift Card

Gift Cards at Cardgifters are only digital solutions. Users of the Service may purchase Gift Cards and send Gift Cards to a Recipient via available digital delivery methods only. Digital Gift Cards require the Recipient to click a “Claim” button or link on the Service or electronic delivery notification and may require the Recipient to log in to the Service. Upon purchase or contribution in the case of a Group Gift, the funds are applied to a Cardgifters Card until such time the Purchaser or Recipient claims the Retailer Gift Card. In the case of a Group Gift, no additional contributions can be made once a Gift Card is claimed.

Notwithstanding anything to the contrary under this Agreement, after thirty-six (36) months Cardgifters allows users of its platform service to purchase and send gift cards to recipients using various delivery methods. Recipients of digital gift cards will need to click a “Claim” button or link on the Service or electronic delivery notification and may be required to log in to the Service. Once purchased or contributed to a Group Gift, the funds are applied to a Cardgifters Card until the purchaser or recipient claims the retailer gift card. In the case of a group gift, no additional contributions can be made once a gift card has been claimed.

It is important to note that if a Cardgifters Card remains inactive for thirty-six (36) months or has not been redeemed for an eligible retailer gift card during this period, Cardgifters reserves the right to apply dormancy fees or expire the Cardgifters Card in accordance with applicable laws. Additionally, Cardgifters may, at its sole discretion, redeem the Cardgifters Card for a retailer gift card selected by Cardgifters and send the selected gift card to the purchaser or recipient’s email address or SMS number on file.

Refund, Return / Exchange Policy

Once a card number has been revealed, we cannot refund the purchase as we cannot restock the item. In the event of a problem with the delivery of the card or a card number that has not been revealed, a refund can be processed. Users can also choose to exchange their gift cards that have not yet been revealed for a “store credit”, where they can purchase other gift cards.

Cardgifters Points Terms and Conditions

Cardgifters may limit enrollment in the Cardgifters Points program at any time. The User earning points from the Cardgifters Points Program agrees not to engage in any behaviour that may be harmful to the interests of Cardgifters, including, but not limited to, attempting to accrue or spend Points in a manner that is inconsistent with the rules of Cardgifters or the intent of this Agreement. Users are not allowed to have multiple accounts or attempt to earn Points through illegitimate channels. Users who engage in fraudulent purchasing or redemption activities will be subject to immediate termination of their account. Cardgifters reserves the right to adjust your Points balance for items that have been returned or transactions that were not completed or were cancelled. Consistently placing orders and cancelling them may lead to account termination. 

Points are unavailable for all brands and cannot be earned or used for promotional purchases unless otherwise specified. Points do not have a cash value and are not transferable upon death or in any domestic relations matter. Points are not the user’s property and may not be transferred to anyone. Any Points that are deemed to have been transferred in violation of the Cardgifters Points Terms and Conditions may be confiscated or cancelled at the discretion of Cardgifters. 

The number of Points awarded and required to redeem a reward may change at any time without notice. Once Points are used to purchase, they cannot be reinstated to the User’s account. Unused Points will expire and be forfeited one year from their earned date unless otherwise defined herein. Cardgifters reserves the right to expire unredeemed Points in accounts inactive for 12 consecutive months or cancelled or disabled for any reason. 

Users must comply with all applicable laws, rules, and regulations, including the Cardgifters Terms. Users acknowledge that their participation in the Points program is subject to such laws, rules, and regulations. Cardgifters reserves the right to interpret and apply the policies and procedures outlined in these Terms of Use. All decisions made by Cardgifters shall be final and binding. Users agree that using the Points program is at their own risk. All Gift Cards are subject to the terms and conditions of the specific retailer. The Points program and all related services are provided on an “as is” and “as available” basis. Cardgifters is not liable for any damages or losses resulting from participation in or inability to participate in the Points program.

Links to Third-Party Sites

Cardgifters provides links to other third-party websites through its Service, but these websites are not under our control or ownership. Please note that we are not liable for these websites’ privacy policies or other practices. As a result, we cannot be held responsible for any problems that may arise, including offensive or malicious content, usability issues, or any other issues related to those websites. You are responsible for reading and comprehending the terms of use or service and policies of any other website you visit.

Intellectual Property

All intellectual property displayed on the Cardgifters Service, including trademarks, service marks, logos, icons, content, and other works of authorship, belongs to either us or our licensors, co-branders, or other third parties. You must obtain prior written consent from the owner of such intellectual property before using it. Third-party intellectual property rights are reserved to the respective third parties. Any unauthorised use of third-party intellectual property may result in legal action against you. Using the Cardgifters Service, you agree to hold us harmless and indemnify us against any losses arising from your unauthorised use of any intellectual property belonging to third parties or Cardgifters.

The Cardgifters logo, name, icons, and marks identifying our products and services are our intellectual property, which you may not use without our prior written consent. We reserve all rights not expressly granted under these terms. You may not copy, sell, resell, or otherwise exploit any aspect of the Service for commercial purposes. All software and other computer code used on or with the Service belongs to us, and none of it may be reverse-engineered, disassembled, decompiled, transcribed, resold, or redistributed without our prior written consent.

You may use one copy of the material from the Cardgifters Service for personal, non-commercial use only. However, you acknowledge that you do not acquire any ownership or other interest in any intellectual property downloaded from the Service. Any text, photo, graphic, audio, and/or video used on or with the Service may not be broadcast, rewritten for broadcast or publication, or redistributed directly or indirectly in any media or stored in a computer except for your personal non-commercial use. By uploading or posting any information, you acknowledge that any such content will be at your sole risk, and we shall not be responsible for any such information or other content you provide to us under any circumstances.

Disclaimer of Warranties

By using the Cardgifters Service, you acknowledge and accept that any loss that arises from such use is solely your responsibility. The Service is provided on an “as is” basis without any express or implied warranties of any kind. Cardgifters and its licensors disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty related to the performance of third parties, including retailers who may fail to fulfil a gift card or ship a product or provide any service purchased with a gift card.

Cardgifters and its licensors do not guarantee that the Service will meet your requirements or that it will be uninterrupted, timely, secure, or error-free. They do not guarantee the accuracy or reliability of any information obtained through the Service or that any defects, including those in software, will be corrected.

Please note that some jurisdictions do not permit the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

Under no circumstances shall Cardgifters be held liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service, including damages for lost profits, even if Cardgifters has been made aware of the possibility of such damages. Furthermore, Cardgifters shall not be responsible for any third-party content uploaded onto or downloaded through the Service. Although some jurisdictions may not allow the limitation of liability for incidental or consequential damages, Cardgifters’ maximum liability to you shall not exceed one hundred (100) euros or the amount paid by you through your use of the Service during the three months immediately preceding the date of your claim, whichever is greater.

Your Indemnity

You agree to defend, indemnify, and hold harmless Cardgifters and its affiliates, directors, officers, employees, agents, and partners from and against any and all losses, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees and court costs, arising from or in any way related to (i) your use of the Service; (ii) any violation of our Terms or policies by you or anyone under your direction or control; (iii) any action or inaction by you or anyone under your direction or control; and/or (iv) any alleged infringement of any law or third-party right by you.

Equitable Relief

When using the Cardgifters Service, you understand and acknowledge that in case you or someone under your direction and control breaches or threatens to breach any Term, damages may not be sufficient to remedy the situation and may cause significant and irreparable injury and damage to Cardgifters. Therefore, you agree that Cardgifters may seek injunctive relief in such an event without waiving any other rights or remedies available under law or by statute.

General Terms

This User Agreement and the Terms shall be governed by the United Kingdom laws, without regard to any provision of law or choice of law rules that might require the application of the laws of any other jurisdiction. In case of any dispute, you and we agree to submit to the state and federal courts of the country, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue to be in full force and effect. Any failure by us to enforce any provision of these Terms shall not constitute a waiver of our right to enforce such provision in the future.

You are not permitted to assign or transfer your rights under these Terms, and any attempt to do so shall be null and void. These Terms shall be binding upon and inure to the benefit of both you and us and our respective successors and assigns.

You agree that in case of any dispute arising from a transaction, agreement, or arrangement with any other user, retailer, or third party related to the Service, you will not involve Cardgifters or any other Indemnified Party in any such dispute or litigation. If you breach this agreement, you shall indemnify and hold us harmless for any costs, reasonable attorney’s fees, and losses incurred as a result, and the jurisdiction for any such dispute shall be limited to the Jurisdiction mentioned above.

Any notice required or given to you under these Terms may be sent by electronic mail to the e-mail address you provide during registration on the Service.

These Terms constitute the complete and exclusive understanding and agreement between you and us regarding the subject matter herein and supersede all prior understandings, agreements, negotiations, and discussions between the parties, whether written or oral.
